How Does a Judge Determine the Amount of Alimony/Spousal Support an Individual Receives?

While every alimony/spousal support case is as unique as the parties involved, there are a few common factors a judge looks for to determine how to award this payment.

The Judge usually considers the following factors:

  • The length of the marriage
  • The age of both parties
  • The health of both parties
  • The income of both parties
  • The current employment and/or employ-ability of both parties
  • The economic and non-economic contribution of both parties to the marriage
  • The ability of each party to maintain the marital standard of living
  • Other factors the court may consider relevant

How Long Does Alimony Last in Massachusetts?

The length of alimony, generally is determined by the couple's union. If the marriage was less than 20 years, the court would impose the following restrictions:

  • Alimony can last no more than 1/2 the length of the marriage for marriages lasting less than five years.

  • Marriages lasting five to ten years, alimony cannot exceed 60 percent of the length of the marriage

  • Marriages lasting more than ten years but less than 15, alimony cannot exceed 70 percent of the length of the marriage

  • Marriages lasting more than fifteen years, alimony cannot exceed 70 percent of the length of the marriage.
